Guest javery Posted November 10, 2001 Posted November 10, 2001 Would Day Care services be reimbursable for a 26 Yr. old with Downs Syndrome? If he gets sick during the year the parents put him in a special needs daycare in order to work would this be a reimbursable expense?

The definition of a "qualifying person" includes a dependant who is either physically or mentally unable to care for themsleves. This is true if it be for part of the year or for all of the year. Source: IRS Publication 17. Also, you need to obtain a copy of IRS Publication 524 to see if you can claim a credit for this individual's disability. earthy

Thus, if one of the spouses does not work, the expense is not reimbursable. (There are limited exceptions if the spouse is a full-time student or unable to care for himself or herself.)
