Would Day Care services be reimbursable for a 26 Yr. old with Downs Syndrome? If he gets sick during the year the parents put him in a special needs daycare in order to work would this be a reimbursable expense?

I believe so. The definition of a "qualifying person" includes a dependant who is either physically or mentally unable to care for themsleves. This is true if it be for part of the year or for all of the year.

Also, you need to obtain a copy of IRS Publication 524 to see if you can claim a credit for this individual's disability.

Remember that, in general, both parents must be employed to qualify. Thus, if one of the spouses does not work, the expense is not reimbursable. (There are limited exceptions if the spouse is a full-time student or unable to care for himself or herself.)
