Guest Ben S Posted December 10, 2001 Posted December 10, 2001 Anyone heard of a provision that disallows eligibility in a DC plan AFTER a certain age? Does anyone have any cites or specifics, or is this ERISA Mythology?
MGB Posted December 10, 2001 Posted December 10, 2001 OBRA'86 and the proposed regulations under it made it clear this is not allowed (it was allowed before this).

david rigby Posted December 10, 2001 Posted December 10, 2001 Depends. Is this plan subject to IRC 410? I'm a retirement actuary. Nothing about my comments is intended or should be construed as investment, tax, legal or accounting advice. Occasionally, but not all the time, it might be reasonable to interpret my comments as actuarial or consulting advice.
