IRC401 Posted February 5, 2002 Posted February 5, 2002 US citizens working overseas have 415 income. Not only should expatriates be eligible to make 403(B) elective deferrals, but the employer may be required to permit them to make the contributions under 403(B)(12). PS: The foreign government may not recognize IRC 403(B) and may tax the elective deferrals.
