Guest Sprout Posted July 26, 2002 Posted July 26, 2002 I am restating a Cross-Tested profit sharing plan to a Safe Harbor 401(k) plan with a cross-tested component on a Corbel Volume Submitter document. I know that I must submit Form 5307, but do I also need Schedule Q, and if so, must I attach Dem 4 and 6? The IRS instructions for Schedule Q seem very broad, so I'm not sure if it's necessary.

You certainly do not have to request a determination of the nondiscrimination testing if you do not wish to. "What's in the big salad?" "Big lettuce, big carrots, tomatoes like volleyballs."
jaemmons Posted July 29, 2002 Posted July 29, 2002 The schedule Q is an optional form now. The determination letter process was split into "two" pieces, so to speak. If all you want is a letter on the form (which I would recommend), no Schedule Q is required to be attached. I never understood the need to submit for a determination letter with respect to operation, since the letter is only good for the year in which information is being supplied in the submission package. I guess the "warm & fuzzy feeling" is good enough for sponsors to seek this reliance.
