Are MERP's required to file 5500's? I don't think so (can't find anything in the instructions that indicate that they do), but I haven't worked with them enough to know for sure.

OK, I'll bite: What do you mean when you use the term "MERP"?

I believe that the correct reference (in the 5500 instructions) is to the filing requirements for welfare plans, not fringe benefit plans. In that case the need to file would depend on whether there were 100 employees in the plan, unless one of the exceptions applied.

Instructions are on page 3, not 4.
