katieinny Posted February 11, 2003 Posted February 11, 2003 If a plan excludes all HCEs, and also excludes some NHCEs, must coverage testing be done?
Guest RBeck Posted February 11, 2003 Posted February 11, 2003 The plan is treated as automatically satisfying minimum coverage. Treas. Reg.1.410(B)-2(B)(6).
katieinny Posted February 11, 2003 Author Posted February 11, 2003 I was concerned because they are excluding some of their NHCEs, too. If coverage isn't an issue, an ER could include just a couple of people by putting everyone else in an excludable class.
