Guest GinGinR Posted April 21, 2003 Posted April 21, 2003 Can an employee work full time hours and sign some sort of waiver saying they do NOT want benefits? I have an employee now that is desperate for hours but we cannot afford to give her the fulltime hours and benefits...she begged me to let her work the hours and sign something saying she refused the benefits...anyone know if this is legal in the state of North Carolina?
Blinky the 3-eyed Fish Posted April 21, 2003 Posted April 21, 2003 Depending on how the document reads an employee can sign an irrevocable waiver to participate in the plan. What you need to be worried about is will the plan still pass the 410(b) coverage requirements. Where's your TPA in all of this? "What's in the big salad?" Erik Read Posted April 24, 2003 Posted April 24, 2003 I think the more import quesiton is can an employee waive coverage of ALL benefits, not just plan participation - employers costs are probably focused on healthcare. Even with the waiver there is no way around the 1/2 Social Security payment - so they employer may still not want to allow the hours. Just my .02 cents.
