Guest pjdawson Posted August 5, 2003 Posted August 5, 2003 Hello, I am trying to find (or develop) a list of cash balance lawsuits. I'd like to find something with basic information about the cases (name of case, quick summary, current status of the case). Do you know of any publicly available sources that would contain this information? If I can't find an available list of cases, I'll have to create my own. So far, I've found information about the cases listed below. Do you know of any other cases involving cash balance plans? *Cooper, et al. v. The IBM Personal Pension Plan and IBM Corporation *Berger v. Xerox Corporation Retirement Income Guarantee Plan *Lyons vs. Georgia-Pacific *Engers v. AT&T Managment Pension Plan, C.A. 98-3660 (D.N.J.) *Amara v. Cigna Pension Plan, C.A. 01-2361 (D.Conn.) *Edsen v. Retirement Plan, Bank of Boston *Aull v. Cavalcade Pension Plan *Eaton v. Onan Corporation *Corcoran v. Bell Atlantic Corp. Thanks in advance for any assistance you can provide. Patrick
GBurns Posted August 6, 2003 Posted August 6, 2003 A Google and FindLaw search will bring up more cases than you have listed. Also if you look at the opinion or briefs for the recent cases there should be cites from other cases. George D. Guest ircreader Posted August 6, 2003 Posted August 6, 2003 There's an excellent article right here in BenefitsLink titled, "Litigation Issues In Cash Balance Plans" by Howard Shapiro and Robert Rachal. It appears to have been written several years ago and talks about many of the cases you have listed.
david rigby Posted August 6, 2003 Posted August 6, 2003 And here it is: http://benefitslink.com/articles/cashbalance.shtml I'm a retirement actuary. Nothing about my comments is intended or should be construed as investment, tax, legal or accounting advice. Occasionally, but not all the time, it might be reasonable to interpret my comments as actuarial or consulting advice.
flosfur Posted August 7, 2003 Posted August 7, 2003 Since most of the litigations are likely to be related to the conversion of traditional DBs to Cash Bal plans, finding the converted cash bal plans should lead to a long list of cases. During my research (through Google) on different aspects of Cash Bal plans I came across a list titled "Companies That Have Converted to Cash Balance Pension Plan" (source: Pensions and Investments). There are 325 companies on this list. I have the hard copy but I cannot find the link now so I cannot give you the link. But if you "google it'" (fast becoming a verb in the internert lingo), you should come across it sooner or later. Or if you give me your fax #, I will fax the list to you.
