Guest ooota Posted September 23, 2003 Posted September 23, 2003 Does anyone know the length of time that an administrator must retain the records of an individual after the plan has terminated? If so, please provide the cite, also. Thanks in advance for your help.
Guest ooota Posted September 23, 2003 Posted September 23, 2003 Individual participant records - such as remittance reports, benefit election forms, etc.
mbozek Posted September 23, 2003 Posted September 23, 2003 The queston is how long is the s/l? Why should employee election forms be preserved in a terminated plan? Remittance reports should be kept for 6 years or until the s/l for an emplyee to make a claim for a mistaken or omitted contribution expires. Under ERISA 107 records used to create annual reports must be kept for 6 years after the report is filed. mjb
david rigby Posted September 23, 2003 Posted September 23, 2003 If the participant was ever put on a Schedule SSA, be sure each participant is (or has been) included on a subsequent SSA as "no longer entitled to deferred vested benefits". See instructions for Line 4. Oops, I just noticed this was a posting in the 403(b) Message Board. Well, you get the idea, anyway. I'm a retirement actuary. Nothing about my comments is intended or should be construed as investment, tax, legal or accounting advice. Occasionally, but not all the time, it might be reasonable to interpret my comments as actuarial or consulting advice.
E as in ERISA Posted September 23, 2003 Posted September 23, 2003 If it's a 403(b), how was it "terminated"?
