Guest benefitsdude6 Posted June 23, 2004 Posted June 23, 2004 If a pension plan provides for the payment of medical expenses (not its primary purpose and the payments are subject to certain restrictions) is it subject to the Privacy Rules?
Steve72 Posted June 24, 2004 Posted June 24, 2004 The definition of "Health Plan" in HIPAA is broader than the ERISA definition. If a pension plan "provides, or pays the cost of, medical care", it may very well be subject to HIPAA.
