Guest Cgross Posted July 22, 2004 Posted July 22, 2004 Our company is having a plan change where spouses are no longer eligible to be covered under our health plan. This change will happen at our next open enrollment period. Do we have to offer the spouse COBRA? I don't think so because it's not a qualifying event. Any opinions?
Guest b2kates Posted July 23, 2004 Posted July 23, 2004 When a loss of coverage is as a result of change of plan design and not a qualified event, the spouse is not entitled to COBRA. Always optional for sponsor to offer. Remember at open enrolllment spouse may be dropped without triggering COBRA If you want to discuss drop me a note and I will gladly give you a call.
