Guest kmvr Posted July 27, 2004 Posted July 27, 2004 Do the non-discriminatory eligibility tests under IRC section 105(h)(3)(A) allow us to exclude (for testing purposes) employees under 25 or with less than 3 years of service even if the plan has less onerous eligibility requirements?
