Guest bigred947 Posted September 28, 2004 Posted September 28, 2004 An employer would like to make a payment to the surviving spouse and children of a deceased key employee. Employer has no plan in place to otherwise provide death benefits. Given the IRS tendency to reject characterization of employer payments as gifts, are there any other means to provide a nontaxable payment?
