One wouldn't necessarily have to aggregated a 401(k) plan and an ESOP for top-heavy testing purposes. They could be members of a permissive aggregation group instead of a required aggregation group.

Do you have to aggregate an ESOP and a 401k plan for testing purposes?

The new 401(k) reg's eliminated the requirement to disaggregate the 401(k) and ESOP's. However, can they still be tested together if desired?
