Guest PRAFALA Posted May 18, 2007 Posted May 18, 2007 Question: Can someone tell me where I can find regulations on the rules behind a not-for-profit (hospital) employer offering multiple 403b vendors yet only matching to one?
J Simmons Posted May 18, 2007 Posted May 18, 2007 IRC 403(b)(12)(A)(i) deals with employer contributions to a 403b annuity. IRC 403(b)(12)(A)(i) refers to, among other provisions, IRC 401(m). IRC 401(m) imposes a nondiscrimination requirement on employer matching contributions. It is referred to as the ACP test. It is described in Treas Reg 1.401(m)-2. TLGeer Posted June 2, 2007 Posted June 2, 2007 You also have t meet the nondiscriminatory availability of benefits, rights and features requirement of 401(a)(4), by covering a nondiscriminatory group.
