dmwe Posted September 5, 2007 Posted September 5, 2007 I have a relative who works 20-25 hours per week, exceeding 1,000 hours in a year and has been, up until now, excluded from participating in her company retirement plan. She'd like to request an SPD or copy of the plan document but is nervous that it may negatively impact her employment. Does anyone have a good suggestion on where to go next for this information? Should she get the DOL involved and have them ask for an SPD for her? She may be in a classification that is excluded from participating but until she sees the SPD, she doesn't really know. Any suggestions are welcome. Thanks
WDIK Posted September 5, 2007 Posted September 5, 2007 First of all, if I were the employer, I would have a more negative reaction toward employees if they stirred up something at the Deparment of Labor than if they simply requested a Summary Plan Description. If your relative cannot bring herself to request the SPD, perhaps she has a kind co-worker that has a copy or would request one for her. ...but then again, What Do I Know?

I wholeheartedly agree with WDIKs response. Definitely do not go to the DOL first. As an aside, I would expect that your cousin has been improperly excluded from coverage.
