If so, NO!Aren't you discussing this in other threads? Last week I started a topic about a multiple er plan trying to allocate 100% of the deduction to the 1040 rather than the 1120. The question apparently was confusing because I've been re-stating facts since then. So I pulled the questions apart. I just need authority. I can't figure out why the corp can deduct with a loss but the self employed can not take the deduction. Are DB deductions limited to the 25% like DC's are? I do not believe IRC 172(d)(4)(D) has anything to do with this scenario. There is no NOL generated from the proposed scheme.

I think a self-employed person can take a deduction for the portion of the contribution representing his/her common law employees even though he/she has no earned income. IRC Section 404(a)(8)© only limits the portion of the contribution made "on behalf of" the self-employed individual.
