mariemonroe Posted January 3, 2008 Posted January 3, 2008 My client failed to sign an amendment to their 401(k) plan updating their plan for the final 401(k) regulations by the end of their 2006 plan year. Any idea on how to fix this?
Guest igglesfan Posted January 3, 2008 Posted January 3, 2008 VCP to the IRS for non-amenders program. Flat $375 filing fee. (take advantage while it's still there). Instructions are in Rev. Proc 2006-27.
Guest Kabert Posted January 19, 2008 Posted January 19, 2008 Is there a board resolution or minutes adopting the amendments? If so, I'd think you have a strong basis for arguing that the amendments were properly (and timely, hopefully) adopted and that signing the actual amendment document was unnessary gravy.
