There is an existing vendor, the contract was issued pre-2004, that will be receiving contributions through the end of this year but not after 12/31/08 (it will be eliminated as a vendor but the participant can leave his money there). Is it grandfathered, do we need to make a good faith effort or what? Rev. Proc. 2007-71 talks about contracts that haven't received contributions since 2004 and contracts that were issued after 2004--but not contracts that were issued before 2004 but are still receiving contributions.
