Assume the benefit is offered outside of the er's health plan. My thoughts are that the arrangements likely are subject to ERISA but I would like to know the DOL's position since that is the one that matters. If it is offered outside the health plan (and I assume you mean the medical plan), isn't there a risk of medical treatment conflict etc ? Shouldn't both be linked/coordinated ? George D. Shouldn't both be linked/coordinated ? It is not linked with the medical plan. For example, if you were having sinus problems or your child had an ear infection, the nurse/doctor could suggest treatment options and/or call in a prescription for you.
