French Posted November 6, 2008 Posted November 6, 2008 We offer single and family coverage An employee is currently covered under his spouse's health plan along with his dependent (she is a currently a student at a local university). He wants to enroll himself and student dependent in one of our health plans during OE to be effective 1/09. On 2/09, he wants to delete his student dependent as she will be enrolling in a health plan at her university (I am assuming that the semester begins again in Feb). This seems to be a qualifying event but we don't specifically state this in any of our documents.
GMK Posted November 6, 2008 Posted November 6, 2008 COBRA qualifying events for dependent children are the same as for the spouse with one addition: for spouse: Termination of covered employee, except for 'gross misconduct' Covered employee's reduction in hours worked Covered employee's becoming entitled to Medicare Divorce or legal separation of covered employee and spouse Death of covered employee one addition: Loss of "dependent child" status under the plan rules I don't see this as a COBRA qualifying event.
Guest parrot87 Posted November 10, 2008 Posted November 10, 2008 There may be a caveat you can use. Is the dependent moving to college? A change of residence can under certain circumstances allow a legal midyear change. If the dependent gains the right to enroll under the university plan as of 2/1, then a change is allowed. Why does the employee wish to move him and his daughter off of his spouses plan then drop his daughter into the university plan?
