I have scanned through everything I can find and nothing talks about voluntary benefits - dental in this particular case. The ARRA specifies that the subsidy is for medical, dental & vision. The only true exclusion I can find is FSA's. I have a client that offers COBRA for their voluntary dental plan. Assuming the employee meets the criteria, are they eligible for the subsidy for this plan? My thought is yes - but that just proves how badly the whole law was thought out! Anyone?
J Simmons Posted February 28, 2009 Posted February 28, 2009 I anticipate that HRAs will find more COBRA continuations being elected for those involuntarily separated 8/1/08-12/31/09 under ARRA given the 65% cost subsidy than under the traditional COBRA rules, given that HRAs are not exempt from ARRA special COBRA rights as health flex accounts are. Guest Tauriffic Posted March 3, 2009 Posted March 3, 2009 If it's not an FSA or if it is exempt from COBRA (with a few exceptions), then you have to offer the subsidy (assume the other requirements are met). I can find no exception for dental COBRA.
