We are about to go to arbitration regards to implementing a alternate schedule or if we lose the arbitration the possibility of implementing a default schedule that can be adversely implemented. We are in a collective agreement and we have a defined plan that is in the critical status, we also have a 13 year rehab plan that has been tenatively approved. We are being told that if we lose the arbitration that a lessor default schedule can be enforced even though another larger group has accepted a better offer. It is my understanding that a arbitrator has the power to implement a better plan or can force us to accept a lessor default schedule. Any input would be greatly appreciated. PabloQ
SoCalActuary Posted February 2, 2010 Posted February 2, 2010 Maybe you could go back and fill in a few facts here. Is this a multi-employer plan in distress? Are you required to make up the underfunding within a limited period of time?

We are being told that even if win we will only get the base rate of !% or 20$ per year accural. We are scheduled for arbitration Feb 23-24. My position is that we still can bargain and try and increase our position and if we win the arbitrator can grant what ever he deems fair. The problem one group of our network with more members has accepted the current pension offer of 30$ per year accurals, we are being told even if we win we would have to accept the base offer which is 1% or 20$ accural per year.
