DPSRICH Haven't heard anything, but am wondering how long it is taking for the employer to get an approval letter back on an extension for the 2009 year.

david rigby Posted June 24, 2010 Posted June 24, 2010 The form is pretty simple. Modification seems unlikely. From 2009 instructions for Form 5500: A plan or GIA may obtain a one-time extension of time to file a Form 5500 annual return/report (up to 2-1/2 months) by filing IRS Form 5558, Application for Extension of Time To File Certain Employee Plan Returns, on or before the normal due date (not including any extensions) of the return/report. You MUST file the Form 5558 with the IRS. Approved copies of the Form 5558 will not be returned to the filer. A copy of the completed extension request must, however, be retained with the filer’s records. I'm a retirement actuary. My 2 cents Posted August 30, 2010 Posted August 30, 2010 It is years now since the IRS had the authority to reject a timely-mailed Form 5558. Even when attachment of the 5558 was required, the only time when it would have been necessary or prudent to attach any sort of approval letter from the IRS is when they mailed one. If the form was filed and nothing further was heard, you had tacit approval and merely had to attach a copy (and in rare instances be prepared to show that it was mailed in time). So employers need not sit by their mailboxes waiting for an approval letter. As the extension requests for 1/1/09 to 12/31/09 plan years had to have been filed a month ago, I hope nobody is sitting out there waiting for an updated Form 5558! Always check with your actuary first!
