Guest LWasserman Posted August 9, 2010 Posted August 9, 2010 Scenario: gov't agency sponsors a MPPP. Allocates X% to staff, Y% to Exec Director (who is an HCE). Do we need to cross test? Am getting differing opinions within the office and have not found anything specific in my research. Thanks!
QDROphile Posted August 9, 2010 Posted August 9, 2010 Government 401(a) retirement plans are not subject to discrimination rules of the sort cross testing addresses unless applicable state law or plan terms provide otherwise.
david rigby Posted August 9, 2010 Posted August 9, 2010 QDROphile is correct. It might be hasty to assume that state/local law is silent on this area. I'm a retirement actuary. Nothing about my comments is intended or should be construed as investment, tax, legal or accounting advice. Occasionally, but not all the time, it might be reasonable to interpret my comments as actuarial or consulting advice.
