They say they become the "common law employer" and sign a collective bargaining agreement with a union. And it will allow for the owners to set up a DB plan that excludes the employees that are in the PEO. I have found one. I was wondering if anyone had names of some others out there that I could contact.

I was wondering if anyone had names of some others out there that I could contact. This sounds like another of those fake union scams. Beware of IRS determination that this is an abusive tax shelter. If you look at the rules for unions and collective bargaining, ask your PEO how they comply.

JAY21 Posted August 9, 2011 Posted August 9, 2011 Often one of the weak links in the unionized PEO structure is the employees often don't even know they are union employees which kind of makes it hard to argue they have collectively bargained for benefits in good faith.
