Guest jfreeborn Posted August 25, 2011 Posted August 25, 2011 I was wondering if anyone could tell me or point in the right direction to find out what exactly must be included in a defined benefit plan's "pension benefit statement" to active participants? Thanks!
frizzyguy Posted August 26, 2011 Posted August 26, 2011 I was wondering if anyone could tell me or point in the right direction to find out what exactly must be included in a defined benefit plan's "pension benefit statement" to active participants? Thanks! That's an interesting question, I have always taken the statement process for granted as far as content was concerned. Every company I have ever worked for had their statements reviewed by an ERISA attorney and any time a change was needed, they got that approved too. That being said, I'm sure Mr. Rigby, and rightfully so, would recommend you consult ERISA counsel to get a definitive answer to this questions. That being said, I did some looking in the dusty ERISA regulations and I think the answers you are looking for lie in ERISA Regs 2520.105-2(e). I would state them, but there is a lot. Also, for a DB plan remember to provide them at least every three years or provide a statement they are available upon request annually. IMHO
david rigby Posted August 26, 2011 Posted August 26, 2011 Start with PPA section 508, which amended ERISA section 105. I'm a retirement actuary. Nothing about my comments is intended or should be construed as investment, tax, legal or accounting advice. Occasionally, but not all the time, it might be reasonable to interpret my comments as actuarial or consulting advice.
