Guest mmaggs Posted April 24, 2013 Posted April 24, 2013 I think I may have a situation where we paid ongoing annuity payments directly to an executor of a deceased participant's estate under the executor's SSN. What are the consequences and steps that can be taken to rectify this situation if this is indeed an issue?
K2retire Posted April 25, 2013 Posted April 25, 2013 The estate should have a separate EIN, not the executor's SSN.
Guest mmaggs Posted April 26, 2013 Posted April 26, 2013 Thanks, What if payments were made to the executor using the deceased person's SSN?
david rigby Posted April 26, 2013 Posted April 26, 2013 If the plan overpaid benefits, it should make an attempt to recover. There have been some previous discussion threads about this. I'm a retirement actuary. Nothing about my comments is intended or should be construed as investment, tax, legal or accounting advice. Occasionally, but not all the time, it might be reasonable to interpret my comments as actuarial or consulting advice.
