Chippy Posted January 17, 2014 Posted January 17, 2014 I have a plan that terminated as of 6/30/2013. I'm filing the final 5500 now, but since the FIRE site is down till February, can I file for an extension for the final 8955?

Chippy Posted January 17, 2014 Author Posted January 17, 2014 Yes, a paper copy could be filed, but with this client, it would be easier to file it electronically. It was a Dr's office, the practice closed and when the office closed, my contract was left go and the Dr is very hard to get a hold of and almost non-responsive. It would just be easier for me to do it electronically if possible. I just wasn't sure since this is the final 8955 if it could be done. If the FIRE site was up and working, I would file the 8955 on time too.

Granted that no further 8955-SSA forms will be filed (and this one should show all individuals previously reported on SSA forms as D's), there is no such thing as a "final" SSA form the way that there are final 5500's, is there? 2. If a plan terminates and purchases annuities for terminated participants with deferred benefits, is the annuity purchase considered cause to remove the person from the SSA's database by reporting them as D's? All benefit obligations that had been owed by the plan have now been satisfied, and the participant has personal control with respect to the benefits promised under the annuity. 3. If the Dr is hard to reach, do you still have the authority to file the form on his or her behalf? Presumably (oh, so naive!) the Dr has not shared his or her filing information (especially password) with you. Wouldn't the electronically filed form have to be electronically signed by an employer or plan official? Always check with your actuary first!
Chippy Posted January 17, 2014 Author Posted January 17, 2014 There isn't a box on the 8955 that says final, so I guess there is not a final SSA. I can file the 8955 electronically, no signature is needed to file electronically on the IRS FIRE site. So, I think I am ok with filing for an extension for the 8955 until the FIRE site becomes available in February.
