jkharvey Posted April 4, 2017 Posted April 4, 2017 Back when we filed extensions for the 6/30/2016 PYE Form 5500, we didn't think carefully about the date and we used 4/15/2017 as the requested extension date. Since that falls on a Saturday with Monday as Emancipation Day holiday in DC, are we ok to file on 4/18 or does the F5558 lock us into 4/15?
RatherBeGolfing Posted April 4, 2017 Posted April 4, 2017 The IRS confirmed last year that the date that should go on the form is the technical extension date (the 15th). If that date falls on a Saturday, Sunday, or a legal holiday, the return may be filed on the next day that is not a Saturday, Sunday, or a legal holiday. You filed with the correct date, and can still file the 5500 on the next day that is not a Saturday, Sunday, or a legal holiday.
chc93 Posted April 4, 2017 Posted April 4, 2017 Also got this from FTWilliam in a support email in June 2016. ************************ Because we can see the argument for both options, we have reached out to the Internal Revenue Service (IRS) and confirmed with them that the Form 5558 should reflect the technical extension date, not the actual extension date. Thus, it is the opinion of the IRS that the Form 5558 always reflect the 15th ************************
My 2 cents Posted April 6, 2017 Posted April 6, 2017 It wouldn't surprise me if the IRS uses some sort of automated program to process 5558s, in which case if you built the weekend delay in, the program would reject the filing as asking for an extension of more than the 2 1/2 months allowed. So don't bother to do that. Always check with your actuary first!

That would be my expectation (although as the 5500 is not a tax form, the existence of a holiday in the District of Columbia might not be determinative for the 5500), but the 5558 should still ask for an extension to 4/15/17. Always check with your actuary first!
TPApril Posted June 1, 2020 Posted June 1, 2020 Howabout Form 5558 due date? Considering that a 5500 would be due on a Monday, say the 31st is a Sunday, can the 5558 be mailed the first business day thereafter?
