Guest JBeck Posted November 15, 2000 Posted November 15, 2000 It is my understanding that the IRS has issued a workplan for 2001 that includes guidance on 403(B) isssues. Where can I obtain more information on this?
Carol V. Calhoun Posted December 20, 2000 Posted December 20, 2000 I have not seen anything indicating that there is a specific regulations or rulings project in this area. However, I was told informally recently by an IRS official that there is some concern about the tax treatment of 403(B) arrangements in which employees are permitted to choose the level of contributions, but the maximum limitations of 402(g) are disregarded based on a theory that the participant's elections are one-time irrevocable elections not covered by 402(g). However, it appeared that the IRS is still at a very preliminary stage in considering that issue, so it is not clear what, if any, guidance will be issued in that area.
