Guest Alison Williams Posted April 24, 2001 Posted April 24, 2001 Can employee charitable contributions to an employer (a 501©(3)) be excluded from taxable wages under the employers cafteria plan?
Moe Howard Posted April 25, 2001 Posted April 25, 2001 No. Charitable contibutions are not one of the 12 pre-tax benefits that may be offered under a cafeteria plan. I suggest you read Internal Revenue Code Section 125. It clearly defines all rules & aspects of cafeteria plans.
Lisa Hand Posted April 26, 2001 Posted April 26, 2001 Actually to get a clear and complete picture of 125 plans you would need to review Section 125 and all the governing regulations as well as have at least one legal guide, which most people asking general questions on this benefit board do not have, which is why they are asking the questions here.
