Divorced, he got a percentage of my marital portion because I retired also from CPD and he also gets a monthly payment from my pension. He is still active. He is retiring this Summer but remarried last summer, will I still get a percentage of his marital portion(lump sum) AND a monthly amount once he retires?

Rather than post your (probably) personal details, the best suggestion is to engage an attorney who is familiar with such distribution(s). (Not all divorce attorneys fit that description.) Make sure that person is familiar with QDROs and also with whatever plan(s) cover CPD* employees. Most federal rules pertaining to a "Qualified Domestic Relations Order" do not apply to plans sponsored by a governmental organization, but the plan itself may have adopted similar procedures. *Might be Chicago Police Department or Charlotte Police Department or Cincinnati Police Department, or maybe something else? LPHR Posted January 13 Posted January 13 My ex-husband works for the federal government. I had a QDRO for the TSP (DC Plan) which was paid out when the divorce was final in 2009. There is a QDRO on the Pension plan...he's eligible to retire this year, so there are QDROs based on Gov't plans. To Msme, is there a QDRO in place for his Pension benefit? A subsequent spouse of your husband's should not impact the marital portion that was assigned to you when you got divorced and the QDRO was signed. Of course, every plan is different. The award of a retirement annuity normally terminate on the death of the participant or the death of the alternate payee and not on the remarriage of either one. It is common for a former spouse to lose the right to a survivor annuity is he/she marries prior to a certain age (usually 55) - unless the employee retired during the marriage and elected survivor benefits the his/her then spouse. On the other hand many plans provide that police, firefighters and corrections employees cannot be required to elect a survivor annuity for a former spouse --- only for a current spouse. You should be able to find out the answer to your question from whoever administers the CBP pension plan, likely some governmental office. If you are a CPD recipient of benefits you have correspondence from them. Call them. If you know the full and exact name of the plan - Google it. David
