30Rock Posted March 19 Posted March 19 403b plan  - calendar plan year has a payroll based match but the plan document allows a discretionary true up at year end. Question -  can we amend the plan at this point in 2025 to add a last day requirement? Or does the last day need to be added 1/1/26? 😊 Thank you!  Â

Posted March 19 Posted March 19 I'm not sure if the rule is the same for 403(b) and 401(a) but my guess it it probably is, but adding a last day requirement if this was a 401(a) (think 401(k) with match) that would be a prohibited cutback because participants had already earned the right to this year's match and the amendment would need to be effective 1/1/26.
Artie M Posted March 19 Posted March 19 Sorry, I don't know the answer to your question but i do recall some IRS Q&A guidance concerning 403(b)'s having a definite true-up match allocation formula that was issued in 2022 or 2023. Maybe run a search with the terms "Q&As" "preapproved" "403(b" and "match" or something like that. Just my thoughts so DO NOT take my ramblings as advice.
