A prospect has had a SOLO DB for three years.  She had a falling out with the actuary and he will not provide copies of the actuarial valuation or Sched SB for the past two years.  I have put her in touch with an ERISA Attorney, but they were not able to help.  Should she terminate the plan and hope for the best?  File a correction with the IRS?

According to the plan sponsor, yes.

If they have been paid for there are certain items the actuary is required to provide to the client. You may want to remind him or her of that and hope to see these items soon or refer it to the ABCD. There might be copying costs for the past reports that were previously provided but I can't image that would be too much.

You mention "File a correction with the IRS".  Do you mean that nothing was filed for the 3 years the plan was in existence?  And no actuarial reports were provided for the 3 years?
