It started as just internal software for my firm but has grown significantly. "When a client simply has NO money, are there remedies? Small 401k Plan, 8-10 total participants. One shoe store bought a 2nd shoe store in 2021. Owner declared Match for 2021 and again in 2022 (both years totaling about $12k). Owner never participated himself. It's a mom-n-pop situation, and the books were kept a little 'loosely'. Owner was in a terrible car accident in 2025, to the point that I'm now working with his son. 2 issues here: Issue #1 (the main problem) is that the owner has no money, and still owes the 401k (pooled) account about $4,300 in order to fully fund the Match from those 2 years. (I know, we're years past when it should have been deposited -- I KNOW.) He now doesn't have the $4,300. The 2nd issue is that the corporate tax returns only claimed $10k as Match expense (vs the $12k that was declared and reported on the 5500s). This 2nd issue may be irrelevant, and the client is reaching out to their tax 'preparer' to get his input. I want to help this client, but I'm not sure what to even suggest."
