(Internal Revenue Service) Analysis: IRS Issues Final Regulations On Classification of Benefit Trusts The Internal Revenue Service has issued final regulations that amend the existing rules defining certain domestic or foreign employee benefit and investment trusts for federal tax purposes. The Small Business Job Protection Act of 1996 and the Taxpayer Relief Act of 1997 amended IRC Sec. 7701(a) by establishing objective criteria for determining whether a trust is a 'domestic trust' for federal tax purposes.
