DOL Broadly Defines When a Summer Camp or Program Is a Child's Place of Care for FFCRA Leave

"In addition to proof of actual enrollment or application to a camp or program, if an employee's child attended a camp or program in the summer of 2018 or 2019 and the child remains eligible for the camp or program for Summer 2020, that may be sufficient.... [If] an employee's child is accepted to a waitlist pending the reopening of a camp or program or the reopening of the camp or program's registration process, that, too, may be sufficient."

FAQs Provide Additional Guidance on Group Health Plan Coverage Under FFCRA and CARES Act

"The reimbursement requirements of CARES Act Section 3202(a) do not apply to any items and services other than diagnostic testing for COVID-19.... The FAQs also indicate that the statute generally precludes balance billing for COVID-19 testing. However, it does not preclude balance billing for items and services not subject to CARES Act Section 3202(a) although balance billing may be prohibited by applicable state law and other applicable contractual agreements."

Experts Push for Limiting Copays, Increasing Migraine Medication Access During Pandemic

"In 2018, excess medical and pharmacy treatment costs for employees with migraine averaged to almost $2000 a year. Those treated for migraine also had an average 2.2 more sick days per year, averaging out to approximately $600 in wages and benefits.... [R]esearchers called on insurers to remove requests for prior authorizations and step therapy requirements for migraine therapies, and reviewed classes of different medicine categories to aid providers in their shift to telehealth services during COVID-19."

"Total HSA assets held at credit unions totaled $1.86 billion as of 3/31/20, up 8% year-over-year.... There were 857 credit unions holding HSA assets as of 3/31/20 (16% of credit unions), up from 840 credit unions three years ago.... Devenir estimates the average HSA balance at a credit union is $2,632 as of 3/31/20, up from $2,513 at the end of 2019."

Employee's Mistake During Open Enrollment 7 Months Ago; OK to Allow 'Correction' of Coverage Election Now?

"An employee just notified us that he forgot to include a dependent child on his dental coverage when electing the plan during open enrollment in November 2019 (the child was selected to be covered under the medical and vision plans). We are wondering if there would be any administrative type reason to allow the child to be covered, retroactive to 1/1/2020, or if doing so would violate Section 125/ERISA rules? There's been no qualified life event or status change to permit a mid-year enrollment. This is purely an issue where the employee just realized their mistake 7 months into the plan year."
