School Reopening Plans May Affect Paid Leave for Working Parents and Employers

Podcast with transcript. "If an employee utilized their [FFCRA] leave previously, maybe to care for a child at the end of the 2019-2020 school year, then that usage actually counts against the employee's 12-week leave allotment going into the 2020-21 school year.... [If] a school is operating at a reduced capacity, so that a child is only permitted to receive in-person instruction a couple of days a week ... and remote instruction on the other days, [FFCRA] leave may be available on the days when the child receives remote instruction."

CDC Revises Guidance for Discontinuing Home Isolation

"As the symptom-based strategy is the preferred strategy in many states and for many employers, this change to the CDC's guidance potentially shortens the period of time employees will need to remain out of work after testing positive for COVID-19 or developing clinically compatible symptoms. The CDC continues to adjust these guidelines based on emergency data on the virus."

San Francisco Aligns Paid Parental Leave Law with State Family Leave

"San Francisco's paid parental leave ordinance (PPLO) ... benefit rate and duration hinge on the state plan's terms.... For all claims with effective dates on or after July 1, 2020, a 2019 state law expands the maximum PFL duration from six to eight weeks to bond with a new child or care for a family member with a serious health condition. Due to this change in PFL benefits, the number of required weeks of supplemental pay under the PPLO also increases from six to eight weeks."


ACA Employer Reporting: Why 2020 May Be Complicated

"Beyond the multitude of coding questions ... companies have downsized. The individual who handled ACA reporting last year may no longer be around this year.... [T]he chaos of 2020 will translate into the assessment of more employer shared responsibility penalties than ever before.... Form 1095-C changed significantly. The IRS added eight new codes (1L-1S), and a line 17 (zip code) to account for the information needed to assess coverage offers related to individual coverage health reimbursement arrangements (ICHRAs). These changes will require alterations to existing employer reporting systems."

"In April 2020, the Supreme Court [ruled] that insurers were entitled to more than $12.2 billion in unpaid risk corridors payments. Following the decision, the lower courts turned to resolving more than five dozen pending ... over these payments.... [A] judgment (or a stipulation for judgment) has now been entered in many of the pending risk corridors cases.... These judgments or stipulations add up to nearly $6 billion."

Client Mailed 2018 5500s Instead of Filing Through EFAST -- Now What?

"Just discovered that client mailed their 5500s for 2018 instead of using EFAST. Does anyone know what happens to 5500s that get mailed? I assume they are treated as not having been filed and we need to do a delinquent filing and pay the penalty?"
