[Guidance Overview]
Ending Health Coverage in Anticipation of a Qualifying Event
"Because the 'in anticipation of a qualifying event rule' looks so much like a COBRA triggering event, some employers find it helpful to, along with the HIPAA creditable coverage notice, also send out a communication explaining that the individual has lost health coverage and that COBRA rights might emerge at a subsequent date. Providing such an advisory notice may trigger a response from a spouse who was unaware of the termination, which will give the plan administrator a good indication whether the coverage was dropped in anticipation of a subsequent divorce." District Court Reinforces Employees' Obligations to Follow Established FMLA Notification Procedures
"The principal issue before the court was whether the employee was entitled to FMLA leave when the employee had failed to follow his employer's usual and customary notice requirements for requesting FMLA leave. The court granted summary judgment in the employer's favor, reinforcing the point that an employee's noncompliance with an employer's notice requirements ordinarily precludes the employee's entitlement to the FMLA's protections." More Is More: Expanding Access to Primary Care Maintaining Quality
"The duration of physician visits, a direct measure of supply constraints, has increased substantially since 2006.... Rates of preventive screening and counseling saw a general pattern of decline between the 2006-2010 and 2011-2013 periods, followed by recovery in 2014-2016.... The primary care system has been able to absorb increases in utilization generated by the ACA without jeopardizing care quality or intensity." MORE >>

Employer-Provided Health Coverage Is a Bargain for U.S. Taxpayers
"A back-of-the-envelope calculation ... reveals that each dollar of federal expenditure yielded approximately $5.34 in benefits for covered employees and their families.... [It] would cost enormously more to provide the same level of financial security for health care needs exclusively directly through government programs than it does to incentivize tax-favored employer-sponsored coverage[.]" MORE >>

District Court Ruling Contradicts Intent of ERISA Disability Benefits Plans
"[The question presented was] whether retirement benefits transferred directly into a rollover account could be offset against the plaintiff's ERISA-governed disability insurance benefits. Although the rollover was not considered receipt of the funds for tax purposes, the court upheld the insurer's finding that the funds [the participant] received reduced her disability payments." [DeBold v. Liberty Life Assurance Co. of Boston, No. 20-11802 (D. Mass. Jun. 28, 2021)] MORE >>
