[Guidance Overview]
Proposed Regs Permanently Extend Due Date to Furnish Forms 1095-B and 1095-C, Clarify Other Lingering Issues
"The proposed regulations provide relief from the penalty under section 6722 for entities required to furnish the Form 1095-B to individuals in certain cases.... Unfortunately, a similar transition relief provision was not extended to the Form 1095-C except in an extremely limited circumstance.... [T]he proposed regulations make it [clear] that the IRS is no longer going to continue to ignore
Forms 1094-B, 1095-B, 1094-C, and 1095-C that are submitted incorrectly or incompletely." MORE >>

IRS Provides ACA Reporting Relief
"[It] isn't yet clear whether these new (or analogous) rules will apply for states with their own individual mandate and reporting requirements (currently, California, Massachusetts, New Jersey, Rhode Island, Vermont, and the District of Columbia). And, in perhaps their only
downside, the proposed regulations confirm the end of the transitional good-faith relief for incorrect or incomplete ACA reporting." MORE >>

Third Circuit: Irregular Request by Claims Administrator for an Outside Medical Report Used to Deny Disability Claim Was Abuse of Discretion
"[T]he court found that [Reliance Standard Life's (RSL's)] decision to request the first IME was of unusual timing and impetus since it [had] just certified [the individual's] disability.... Though a fiduciary can seek an IME at appropriate stages of the claims
process, 'the timing of and professed need for the IME were irregular.' The court found the second procedural anomaly to be RSL's request for two peer reviews after it decided to overturn the initial decision." [Fulton Financial Corporation Employee Benefit Plan; Reliance
Standard Life Insurance Company, No. 19-3855 (3d Cir. Nov. 26, 2021)] MORE >>

Telemedicine Will Remain Even as the COVID-19 Crisis Recedes
"Three times as many consumers say they plan on continuing to use telehealth services, and more than half of providers view it more favorably now than before.... Telemedicine has proven itself to produce a trifecta of benefits: patients enjoy it and some often prefer it, it
reduces costs, and it improves outcomes. Not many calls are this obvious in the world of health care." MORE >>

Are These Plans Subject to Broker Compensation Disclosure? Voluntary Critical Illness, Vol. Cancer, Vol. Hospital Indemnity
"NAHU and others have stated ERISA Section 733(a) defines group health plan to include Dental and Vision for disclosure purposes. Are the voluntary group products CI, Cancer, and HI included in
the defined plans? Not purely list-billed Individual CI, Cancer, HI plans. Each covers medical care and is sold to groups via payroll pre-tax reduction through a Section 125 Plan, so they're included in ERISA plan documents."
