Eighth Circuit: District Court Improperly Resolved Factual Disputes on Summary Judgment in ERISA Benefits Case
"[T]he Eighth Circuit ruled that the district court's decision on summary judgment was improper because it weighed evidence, made credibility determinations, and made findings on disputed factual questions in the administrative record.... The Eighth Circuit concluded,
however, that the district court's error was harmless ... [and] affirmed the district court's decision granting plaintiff summary judgment. Of controlling import, the parties confirmed that neither had new evidence to submit should the court remand the case for a bench trial." [Avenoso v. Reliance Standard Life Ins. Federal Contractor and Subcontractor Vaccine Mandate Enjoined Nationwide

efficiency and economy in procurement and contracting.... [E]mployers may still choose to adopt voluntary vaccine mandates applicable to employees but must be cognizant of the states that have adopted laws limiting or banning vaccine mandates." [State of Georgia v. Biden,
No. 21-0163 (S.D. Ga. Dec. 7, 2021)] MORE >>
