Court Credits Treating Physician Over Retained Experts

HIPAA vs. ERISA Claims Procedures
"ERISA's broad disclosure obligations in the context of claims and relatively loose authorization standard is somewhat at odds with HIPAA's more narrow focus on protected health information and more stringent requirements for disclosing that information.... This case is
instructive that employers should not just stay silent, even if the HIPAA authorization is defective in some manner." [Wilson v. UnitedHealthcare Ins. Co., No. 20-2044 (4th Cir. Feb. 24, 2022)] MORE >>

Form 1095-C as Affected by Lookback Period for Employees Not Employed for Full 12 Months
"If we used a 12 month lookback period to determine 'eligibility,' do we need to issue Form 1095-C to people who were not employed for a full 12 months? Because we use that 12 month lookback period to determine 'full time,' it stands to reason that any employee
not employed for at least 12 months is categorically NOT full time. Thoughts?"
