Short-Term Disability Considerations for Employers in States with Mandated Benefits
"Although [paid family and medical leave (PFML)] program designs vary by state, ... [t]hese benefits are very similar to the short-term disability (STD) benefits that many employers offer their employees either through fully insured or self-insured methods. The similarities
between PFML and STD benefits can create challenges in administering the benefits concurrently. This article discusses some of the key considerations for employers in states with mandated PFML benefits." MORE >>

The Impact on Premiums of Expanding Pre-Deductible Coverage in HSA-Eligible Health Plans
"The impact on premiums of expanding pre-deductible coverage for 14 services in HSA-eligible health plans ... is small. Estimated premium increases range from virtually zero to 1.5 percent.... [EBRI] found a 0.9 percent increase in premiums when use of health care

Fiduciary Duties for Health and Welfare Plans: Duty to Administer Plan According Its Written Terms
"Maintaining a plan document is a core ERISA requirement. Plan administrators must administer the plan according to the plan document. While plan participants and even plan administrators may not agree with the plan language, this is still the controlling language of the plan and

CRS in Focus: Funding of Postal Retiree Health Benefits in the Postal Service Reform Act of 2022
"Since FY2007, the U.S. Postal Service (USPS) has experienced annual net losses averaging $6.2 billion due in large part to retiree health prefunding payments that were required under the Postal Accountability and Enhancement Act of 2006 (PL 109-435). The Postal Service Reform Act of 2022 [PSRA] (PL 117-108) repeals those prefunding payments and eliminates USPS's defaulted payments from its financial balance sheet. Additionally, the PSRA's changes to postal health benefits are expected to reduce USPS's share of premiums for its employees and retirees by $5.711 billion over 10 years." Congress Considers Banning Discretionary Clauses in ERISA Plans
"[T]he 'Employee and Retiree Access to Justice Act' [HR 7740] ... seeks to ban arbitration and discretionary
clauses in employer-sponsored benefit plans governed by [ERISA] ... thereby forcing plan disputes into the judicial system[.] [T]his legislation, if passed, would dramatically alter the long-standing standard of review by courts when a plan participant or beneficiary is denied retirement, health, or other benefits under an ERISA-regulated plan."
