"The City of Philadelphia has enacted an ordinance requiring commuter benefits for employees, effective December 31, 2022 [which] applies to employers who employ 50 or more 'covered employees' in Philadelphia (excluding government employers). A covered employee for

"[A] close review of the statutory language, the regulations, and the preamble explaining the various regulations make it clear that a section 1411 notice was a precondition to an employer being penalized under IRC section 4980H. As a result, employers who do not
