Texas Judge Finds Preventive Care Mandate Must Yield to Statutory Religious Protections

"This ruling is significant in that it shows the increasing tension in jurisprudence between public health of employees and society-at-large on the one hand and the religious rights of private employers on the other.... [T]his ruling provides fertile ammunition for employers to argue that their religious beliefs justify their exemption from a whole host of otherwise required medical treatments, including birth control and Plan-B." Premium-Only Plan Documents and Cafeteria Plan Nondiscrimination Requirements

"We are a small organisation (less than 10 staff) and have been told by our payroll company that we need to establish a cafeteria plan to be able to do pre-tax health & dental insurance. The payroll company offer a POP plan doc for $400 which includes a nondiscrimination testing kit. We think we qualify for a simple cafeteria plan and if we are right, nondiscrimination testing shouldn't be necessary. [1] Is there anything we should be alert to using the payroll company plan document, i.e., is that usually OK or should we be getting the doc from somewhere else? [2] Who could tell us whether we do in fact qualify for the safe harbour, i.e., who provides opinons on this stuff? We are a non-profit, so we're fee-conscious."
