DOL Issues Its Final Word on ESG and Proxy Voting
"[T]he DOL significantly softened the regulatory text on ESG without removing references to ESG altogether. It eliminated ... the attempt to define certain ESG factors in favor of three principles outlining what it considers to be relevant to a fiduciary's duty of
prudence ... These new principles appear to offer significant deference to a fiduciary's own determinations of what is important to an investment decision[.]" MORE >>

Eighth Circuit Vacates 177 Arbitration Awards Against DST Systems Due to Lack of Subject Matter Jurisdiction
"The question is whether a state-law claim necessarily raises a federal issue which a federal forum may entertain without disturbing any congressionally approved balance of federal and state judicial responsibilities. Plaintiffs sought relief under the DST Arbitration Agreement,
which is part of their employment contracts that specifically excludes claims for 'ERISA-related benefits.' The court found that this is not state contract law that relates to DST's ERISA Plan." [Hursh v. DST Sys., Inc., Nos. 21-3554+ (8th Cir. Nov. 28,
2022)] MORE >>

Resetting the Mindset: DC Lifetime Income 'Decumulation Accumulations' and Their Risk-Related Restrictions
" '[A]ccumulating decumulation' rights is very much different than merely accumulating investment assets under a plan. In order to benefit from the value of these enhancements, participants and fiduciaries must be comfortable with accepting some restrictions on
accessing plan funds. This is so very opposite to the mutual fund, daily trading world to which participants have become accustomed." MORE >>

Platinum 401k Letter to EBSA Requesting Clarification on Scope of Pooled Employer Plan Annual Audits (PDF)
"[W]tihout guidance to the contrary ... Pooled Employer Plan auditors are including each adopting employer ... as part of their audit review ... A broad overreaching annual plan audit requirement of this type for a Pooled Employer Plan would have a chilling effect
on one of the key advantages associated with an employer opting to join a Pooled Employer Plan.... Reviewing every single adopter is excessive[.]" MORE >>

Are Retirement Plans Too Complicated and at Risk of Becoming Even More So?
"[T]he complexity reinforces and in many ways increases the inequities built into the system, by making it harder for smaller employers to provide retirement benefits and for employees, across the board and regardless of the size of their employer, to access and make use of
them.... It is simply too complex an area for small employers, who are not trying to do anything fancy but instead simply trying to provide industry standard defined contribution plans for their employees." MORE >>

The Ins and Outs of IRA-to-HSA Rollovers
"The most important thing to know about a qualified HSA funding distribution is that it is a once-in-a-lifetime opportunity for each HSA account holder. The second most important thing to know is that the maximum amount of the rollover is limited to the amount of that year's
HSA contribution limit." MORE >>

Late Filing Letters from the IRS Being Sent to Plan Sponsors of 5500-EZ Plans
"We've received 3 letters from plan sponsors in the past week saying that their Form 5500-EZ plans were filed late, with huge penalties. But all three 5500-EZs were filed on time. Has anyone else had plan sponsors receive these letters? We tried to call the IRS and got a
message that 'due to high volume' we should 'call back tomorrow.'"

Estimated TPA Fee Approved by Client in Engagement Letter But Billable Hours Less Than Expected
"Fee Example: a TPA quotes $15k to $20K for TPA work for a plan year for a new client, not knowing what the records will look like. The plan sponsor signs an engagement letter agreeing to the fee range. Time tracked to complete the year ends up being $12,000. Is it ethical for
the TPA to bill $15,000? Can a client demand to see time entries?"

Termination Date of Employee Who Stops Working But Is Not Taken Off the Payroll
"An employee stopped working for a company for a certain period of time, was kept on payroll such that he's not officially terminated from the company. Would you consider his termination date to be the day he/she stopped working for them, or the date he is no longer on the
payroll? I'm thinking the latter."

Employee Wants Exception from Plan Participation for Religious Reasons
"Plan sponsor has an employee who wants to be excluded from the plan due to religious reasons. Eligible employees receive the 3% SH and a small PS. It is not workable to exclude him by job definition or class, location, etc. Very strange and I will tell the sponsor he must
participate. Maybe use the beneficiary designation to assuage his objection to the plan, whatever that might be."
