Text of Instructions for 2023 IRS Form 1095-A: Health Insurance Marketplace Statement (PDF)

"Form 1095-A is used to report certain information to the IRS about individuals who enroll in a qualified health plan through the Health Insurance Marketplace. Form 1095-A is also furnished to individuals to allow them to take the premium tax credit, to reconcile the credit on their returns with advance payments of the premium tax credit (advance credit payments), and to file an accurate tax return." "The [IRS] has issued Notice 2023-70 to increase the Patient-Centered Outcomes Research Institute (PCORI) fee amount for plan years ending on or after Oct. 1, 2023, and before Oct. 1, 2024. The updated PCORI fee amount is $3.22 multiplied by the average number of lives covered under the plan. For plan years that ended on or after Oct. 1, 2022, and before Oct. 1, 2023, the PCORI fee amount is $3.00 multiplied by the average number of lives covered under the plan."  MORE >>

HHS Announces Increases in Civil Monetary Penalties for Violations of HIPAA (PDF)

"HHS recently issued a final rule which sets out the inflation-adjusted civil monetary penalty (CMP) amounts that HHS is authorized to assess for violations of HIPAA. [A chart shows the] adjusted CMP amounts are applicable to certain types of violations that occur after November 2, 2015, for which CMPs are assessed on or after October 6, 2023."  MORE >>

What Are the Health Plan ID Card Transparency Requirements? (PDF)

"For plan years beginning on or after January 1, 2022, any physical or electronic plan or insurance identification card issued to group health plan participants or beneficiaries must clearly state ... [1] any applicable deductible; [2] any applicable out-of-pocket maximum limitation; and [3] a telephone number and internet website address through which the individual may seek consumer-assistance information ... The agencies have advised that they intend to issue rules addressing implementation of this requirement, but in the meantime, plans are expected to implement the ID card requirements using a good faith, reasonable interpretation of the law. "  MORE >>

IRS Announces Tax Relief for Leave Donations to Aid 2023 Hawaii Wildfire Victims (PDF)

"The IRS has announced special tax relief for leave-based donation programs set up by employers to aid victims of the State of Hawaii wildfires that began on August 8, 2023. Under a leave-based donation program, an employer may permit employees to give up their vacation, sick, or personal leave in exchange for cash payments by the employer to qualified charitable organizations. Ordinarily, leave-based charitable donations are included in a donating employee's wages or income."  MORE >>
