DOL Investment Advice Fiduciary Rule Includes Changes from 2023 Proposal

"The final definition is substantially broader than the 1975 rule, however, it is significantly narrower than DOL's 2023 proposal. As an example, DOL has recognized that a variety of sales activity does not give rise to fiduciary status.... This opens up a range of possibilities for interactions amongst sophisticated parties to remain non-fiduciary in nature in a way that may not have been possible under the Proposal.... While most of the changes [to PTE 2020-02] added burdens, e.g., expanded disqualification provisions, DOL did respond to some industry requests for more flexibility ... [T]he final PTE 84-24 amendment considerably narrows the community of insurance professionals eligible for exemptive relief for the receipt of compensation in connection with the recommendation of insurance and annuity products."  MORE >>

DOL Releases Final Investment Advice Fiduciary Rule

"The final rule narrows the contexts in which a covered recommendation will constitute ERISA fiduciary investment advice and makes clear that the test for fiduciary status is objective ... [A] new paragraph in the regulatory text confirms that sales recommendations that do not satisfy the objective test will not be treated as fiduciary advice, and that the mere provision of investment information or education, without an investment recommendation, is not advice within the meaning of the rule."  MORE >>

IRS Provides (Another) Temporary Waiver for Certain RMDs

"Notice 2024-35 extends the relief period through 2024, waiving the excise tax for failure to take RMDs during this period for those beneficiaries subject to the 10-year rule in 2024. The Notice also confirms that failure to make these RMD payments during the extended relief period will not jeopardize plan qualification.... [T]his RMD waiver only applies to beneficiaries utilizing the 10-year rule and not the eligible designated beneficiaries utilizing the life expectancy rule."  MORE >>

"[B]eneficiaries subject to the 10-year rule and obligated to take annual required minimum distributions get a waiver of the 25% excise tax that could have otherwise applied to their 2024 RMDs. Taxation of Restoration Payments to Have Forfeitures Restored

"Participant X is a participant in A's profit-sharing plan. After completing a few years of service, X quits when he is 40% vested and takes a distribution of his vested account balance. For simplicity's sake, let's say that the X's account balance is $10,000 and that his vested portion is $4,000. A's profit-sharing plan provides for the immediate forfeiture of the non-vested account balance upon distribution of the vested portion, subject to a repayment provision. Two years later, A rehires X. Let's say that X repays his $4,000 distribution and has the previously forfeited $6,000 portion restored. A few years later, X terminates his employment with A and receives a distribution of his fully vested account balance, which was then $20,000. A couple of questions: [1] in the year when X repaid the $4,000 to A's profit sharing plan, was the repayment made with after-tax money or was it made with pre-tax money? Was the repayment amount treated as a rollover? [2] when X took a distribution of his then fully vested account balance, was the taxable portion limited to $16,000 or was it the full $20,000?"
