District Court Vacates HIPAA Web Tracking Guidance

"At the heart of the dispute was the guidance released by HHS in December of 2022 and then updated again in March of 2024, which suggested that information collected from unauthenticated website visitors could be considered protected health information (PHI) under HIPAA. District Court Says Employer's COBRA Notice May Rely on Address Provided by Employee

"[The court explained] that even if CEO knew where the plaintiff lived, there was no evidence that the CEO knew that the plaintiff could not also receive mail at the address that was on file. Further, ... to act on such knowledge, the CEO would have had to reach out to the employee and instruct him to change his address or to unilaterally change the address in the health insurance system without the employee's permission. "Using exposure to price increases caused by horizontal hospital mergers as an instrument, [the authors] show that rising prices raise the cost of labor by increasing employer-sponsored health insurance premiums. A 1% increase in health care prices lowers both payroll and employment at firms outside the health sector by approximately 0.4%.... Affiliated Company/Same Controlled Group for an Acquired Company

"The company I was working for was acquired back in March. The health and welfare benefit plan runs on a calendar year. Acquiring company is moving all employees to the new company's benefit plan effective 7/1 (also calendar year). We are shutting down all existing benefit plans on 6/30. For HCFSA contribution limits, would we treat these 2 plans as affiliated/same control group plans -- meaning that between the 2 plans, participants could not elect more than the annual 2024 annual limit of $3200? How do we treat employees who may have overspent their accounts? (Employee elected $3200, only contributed $1600, but already received $3200 in reimbursements?) Can they make an election with the acquiring company, if so, how much?"
